A bill will be submitted to the State Duma giving Roskomnadzor the authority to determine the list of domain names

According to the Decree of the Government of the Russian Federation dated December 30, 2021, containing the proposed plan of legislative activities for 2022, it is planned to submit a bill to the State Duma that gives the Government the authority to approve the procedure for registering domain names and Roskomnadzor the right to determine the list of domain names:

“in terms of empowering the Government of the Russian Federation with the authority to approve the procedure for registering domain names included in the group of domain names that make up the national domain zone, and to create a special registrar of domain names belonging to the state authorities of the Russian Federation, state authorities of the constituent entities of the Russian Federation, local authorities , state organizations, as well as in terms of empowering Roskomnadzor to determine the list of domain names owned by such bodies and organizations. The bill amends Articles 2 and 142 of the Federal Law "On Information, Information Technologies and Information Protection" and Article 1 of the Federal Law "On Providing Access to Information on the Activities of State Bodies and Local Self-Government Bodies". The Ministry of Digital Development and interested federal executive bodies are responsible for the preparation and support of the draft law. The project is planned to be presented to the Government in July this year and submitted to the State Duma in November.

As the invited expert of the Interfax publication noted, the bill “expands the powers of Roskomnadzor, giving it the right to independently determine the list of domain names belonging to state authorities, constituent entities of the Russian Federation, municipalities, certain types of NGOs and state organizations.

“Also, the RKN may require the transfer of administration rights to such domains from third parties if they are registered, for example, not with the proper authority. That is, we are talking about the standardization and cataloging of domain names significant for the state used by state and other bodies, as well as enterprises in their activities. For the same purposes, it is planned to create a special registrar: it will serve such domains, ”the Interfax expert said.

Currently, the registration rules are regulated by a coordination center established by the state (including Roskomnadzor). If the bill is adopted, Roskomnadzor will be able to directly deal with the issues of regulating the domain space of the Russian Federation and independently determine the rules of the domain zone. As the Interfax expert noted, first of all, the regulation will affect significant domain names, in particular, those belonging to the state authorities.
