Moldova - Alexander Stoianoglo filed two complaints with the ECtHR

Moldova (bbabo.net), - Suspended Attorney General Alexandru Stoianoglo, through his lawyers, filed two complaints with the European Court of Human Rights (ECtHR) due to circumstances in which “national courts restricted certain rights to him.” At a press conference, one of lawyers, Victor Munteanu, stated that the first complaint relates to the fact that his client's right to move was restricted, as well as to the fact that "the procedures for initiating criminal prosecution were completely arbitrary", reports ipn.md

Several appeals were filed against Alexander Stoianoglo. On October 5, he was to report to the Supreme Council of Prosecutors (SCP). According to the procedure, the SCJ had to decide on the proposal whether or not to proceed with the prosecution and decide whether the same prosecutor or another should conduct the prosecution. According to Victor Munteanu, in the case of Stoianoglo, the criminal prosecution was immediately initiated by the prosecutor, who was only authorized to examine the originally filed complaint.

The second application filed with the ECHR concerns the fact that Alexandru Stoianoglo was removed from the post of Prosecutor General by the decision of the SCJ on October 5. A series of proceedings followed in the national courts, where Alexander Stoianoglo complained that he had been unjustifiably removed from the post of Prosecutor General. The national courts, the Chisinau Court of Appeal and the Supreme Court of Justice did not even want to consider the case on the merits. The initial statement also indicated that the removal from office and the initiation of criminal proceedings were based on political criteria.

The lawyers asked to join the two applications to the ECtHR and consider them as a priority.

Victor Munteanu regards the dismissal of the Prosecutor General and the criminal cases initiated against him as an abuse. Precisely in order to remove him from office, amendments were made to the Law on the Prosecutor's Office, very promptly, during the holidays, “with a clear political overtone,” the lawyer said. The Venice Commission has criticized the haste with which the legislative changes have moved forward and questioned the need to remove the Prosecutor General, added Victor Munteanu.

According to the lawyer, Alexander Stoianoglo continues to be illegally deprived of certain rights, although the court changed his preventive measure - from house arrest to judicial control. From his point of view as a lawyer, the court introduced absurd restrictions that are not in the law. For example, a ban on appearing at the prosecutor's office when he is under investigation. He was also denied the right to communicate with the press, to participate in public debates.
